Abstract

This paper considers the era of executive action which followed the immediate aftermath of 9/11 terrorist strikes in New York and the impact on United Kingdom domestic law leading to detention without trial ("Belmarsh") and control orders rather than prosecutions ("Old Bailey"). The first part of the paper examines the foundations for the reinvigoration of criminal justice in the UK and the second part explores the present and future implications for criminal justice.Article by Professor Clive Walker (Professor of Criminal Justice Studies at the University of Leeds) published in Amicus Curiae - Journal of the Society for Advanced Legal Studies.
