Abstract

The Strasbourg-based Court and Commission of Human Rights have both attached great importance to the prohibition of discrimination. In this article, Yutaka Arai examines their approach, which leaves national authorities with only the narrowest margin of appreciation on the issue. Article by Yutaka Arai (Research student, University of Cambridge) published in Amicus Curiae - Journal of the Institute of Advanced Legal Studies and its Society for Advanced Legal Studies. The Journal is produced by the Society for Advanced Legal Studies at the Institute of Advanced Legal Studies, University of London.
